Please read the following terms and conditions carefully before registering, accessing, browsing, downloading or using the Site (defined below). By accessing or using the Site or by using the Service (defined below), you agree to be bound by these terms and conditions set forth below including any additional guidelines and future modifications. If at any time you do not agree to these terms and conditions or do not wish to be bound by these terms and conditions, you may not access or use the site and immediately terminate your use of the services. Your Agreement to these Terms and Conditions for availing Service. The Terms and Conditions (as may be amended from time to time, the “Agreement”) is a legal contract between you being, an individual customer, user, or beneficiary of this service of at least 18 years of age, and Dami Technologieshaving its Regd. Office: Kerala-689621, India. All services are rendered by Dami Technologies through its platform under the brand name ‘PayPappa’. Hence all the rights, benefits, liabilities & obligations under the following terms & conditions shall accrue to the benefit of Dami Technologies. (together with its subsidiaries and other affiliates, “us”, “We” or “PayPappa”), regarding your use of our prepaid mobile/DTH recharge purchasing services to purchase prepaid mobile/DTH recharge (known as “Recharge”) or Services regarding Semi Closed Wallet of online PayPappa Marketplace or such other services which may be added from time to time (all such services are individually or collectively are referred as Service or Services as they case may be). Service can be used by you subject to your adherence with the terms and conditions set forth below including relevant policies. PayPappa reserves the right, at its sole discretion, to revise, add, or delete portions of these terms and conditions any time without further notice. You shall re-visit the “Terms & Conditions” link from time to time to stay abreast of any changes that the “Site” may introduce.

Eligibility

The "User" who has complete 18 years of age or above to register and avail the any services of the "Site". By accepting these Terms & Conditions or by otherwise using the Services or the Site,The services are not available to persons under the age of 18 or to anyone previously suspended or removed from the services by PayPappa. By accepting these Terms & Conditions or by otherwise using the Services or the Site, You represent that You are at least 18 years of age and have not been previously suspended or removed from the Services. You represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement. You shall not impersonate any person or entity, or falsely state or otherwise misrepresent identity, age or affiliation with any person or entity.

RECHARGE

PayPappa has tied up with a third party enabler for the recharge. PayPappa is not responsible for any delay, pricing or cancellation of recharge from mobile operators end. Though, best efforts are made to keep the service above acceptance levels.User is solely responsible for the selection of mobile operator and the recharge amount. PayPappa is not responsible for talk-time given against recharge done through PayPappa.com as this is purely at mobile operator's disposal. PayPappa is only a reseller of prepaid mobile services by telecommunications service providers (‘Telcos’) or the providers of such prepaid recharge or other distributors or aggregators. PayPappa is not a warrantor, insurer, or guarantor of the services to be provided by the Telco’s. Recharge sold by us to you is sold without recourse against us for any breach of contract by the Telco. Any disputes regarding the quality, minutes provided, cost, expiration, or other terms of the Recharge purchased must be handled directly between You (or the recipient of the Recharge) and the Telco.

BILL PAYMENTS

In order to use the Service, you may need to obtain access to the World Wide Web, either directly or through devices that access web-based content, and pay any service fees associated with such access. In addition, you must have all equipment necessary to make such connection to the World Wide Web, including a computer and modem or other access device. PayPappa and/or the PayPappa business partner reserve the right to charge and recover from the User, fees for availing the Services. These changes shall be effective from the time they are posted on to the PayPappa Website or over the PayPappa business partner channel through which you are availing the Service. You are bound by such revisions and should therefore visit the PayPappa Website or check with the PayPappa business partner channel through which you are availing the Service to review the current fees from time to time. In the event that you stop or seek a reversal of the Payment Instructions as may have been submitted, PayPappa shall be entitled to charge and recover from you and you shall be liable to pay such charges to the Bill Payment Service as may be decided by PayPappa. These charges shall be charged on to your designated Payment Account or in any other manner as may be decided by PayPappa. PayPappa offers a convenient and secure way to make payments towards identified Biller(s) using a valid Payment Account. Depending upon the PayPappa business partner through whom the Service is availed by you (i) the specific features of the Service may differ (ii) the number of Billers available over the Service can differ (iii) the type and range of Payment Accounts that can be used to issue a Payment Instructions can differ and (iv) the modes/devices over which the Service can be accessed can differ; and (v) the charges, fees for availing the Service or any aspect of the Service can differ. Specific details related to these aspects would be available with the PayPappa business partner or the channel over which the Service is being availed. From time to time, PayPappa, at its sole discretion, can add to or delete from such list of Billers or types of Payment Accounts that can be used in respect of making payments to a Biller. In any event (i) the type and range of Payment Accounts that can be used for making payments may differ for each Biller depending on Biller specifications (ii) there may be an additional fees/charge when using certain types of Payment Accounts in respect of a Biller; and (iii) the terms upon which a payment can be made to a Biller can differ depending on whether a Card or a Bank Account is used to issue the Payment Instruction. Further depending on the specific facilities allowed by a PayPappa business partner, payments to a Biller can be made either (a) by issuing a Payment Instruction for an online debit/charge to a Payment Account; or (b) by scheduling an automated debit to a Payment Account.

In using the Bill Payment Service, you agree to:

.        Provide true, accurate, current and complete information about yourself (“Registration Data”), your Payment Account details (“Payment Data”), your Biller details (“Biller Data”) and

.        Maintain and promptly update the Registration Data, Payment Data and Biller Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or PayPappa has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, PayPappa has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof). The term biller includes telecom operators.

PayPappa assumes no responsibility and shall incur no liability if it is unable to affect any Payment Instruction(s) on the Payment Date owing to any one or more of the following circumstances:

.        If the Payment Instruction(s) issued by you is/are incomplete, inaccurate, invalid and delayed.

.        If the Payment Account has insufficient funds/limits to cover for the amount as mentioned in the Payment Instruction(s).

.        If the funds available in the Payment Account are under any encumbrance or charge.

.        If your Bank or the NCC refuses or delays honoring the Payment Instruction(s).

.        If payment is not processed by biller upon receipt.

.        Circumstances beyond the control of PayPappa (including, but not limited to, fire, flood, natural disasters, bank strikes, power failure, systems failure like computer or telephone lines breakdown due to an unforeseeable cause or interference from an outside force).

.        In case the bill payment is not effected for any reason, you will be intimated about the failed payment by an e-mail.

Returns and refund policy for Recharges & Bill payments:

.        All sales of Recharge are final and there will be no refund or exchange permitted. Please be advised that You are responsible for the mobile number or DTH account number you purchase Recharge for and all charges that result from those purchases. PayPappa is not responsible for any purchase of Recharge for an incorrect mobile number or DTH account number. However, in a case where a transaction has been completed by you on the Site, and money has been charged to your card or bank account but a Recharge has not delivered within 24 hours of your completion of the transaction then you may inform us by sending an email to our customer services email address "[email protected]" mentioned on the Contact Us page. In such a scenario you will be entitled to a full refund. We request you to include in the email the following details - the mobile number or DTH account number, operator name, Recharge value, Transaction date and Order Number PayPappa shall investigate the incident and if it is found that money was indeed charged to your card or bank account without delivery of the Recharge then you will be refunded the money within 7 working days from the date of the receipt of your email.

Bus Booking Terms

.        PayPappa * is only a bus ticket agent. It does not operate bus services of its own. In order to provide a comprehensive choice of bus operators, departure times and prices to customers, it has tied up with many bus operators and service providers.

.        PayPappa’s advice to customers is to choose bus operators they are aware of and whose service they are comfortable with.

PayPappa’s Responsibilities Include:

.        Issuing a valid ticket (a ticket that will be accepted by the bus operator) for its’ network of bus operators.

.        Providing refund and support in the event of cancellation.

PayPappa’s Responsibilities Do Not Include:

.        The bus operators bus not departing / reaching on time.

.        The bus operator's employees being rude.

.        The bus operator’s bus seats etc. not being up to the customer’s expectation.

.        The bus operator canceling the trip due to unavoidable reasons.

.        The baggage of the customer getting lost / stolen / damaged.

.        The bus operator changing a customer’s seat at the last minute to accommodate a lady / child.

.        The customer waiting at the wrong boarding point (please call the bus operator to find out the exact boarding point if you are not a regular traveler on that particular bus)..

.        The bus operator changing the boarding point and/or using a pick-up vehicle at the boarding point to take customers to the bus departure point.

.        The arrival and departure times mentioned on the ticket are only tentative timings. However, the bus will not leave the source before the time that is mentioned on the ticket.

Passengers are required to furnish the following at the time of boarding the bus:

.        A copy of the ticket (A print out of the ticket or the print out of the ticket e-mail).

.        Identity proof (Driving license, Student ID card, Company ID card, Passport, PAN card or Voter ID card). Failing to do so, they may not be allowed to board the bus.

.        All tickets issued shall be non-transferable.

.        Passengers are required to reach the boarding place before 30 min of scheduled departure time.

Change of bus:

.        In case the bus operator changes the type of bus due to some reason or any other discrepancy, we will refund the differential amount to the customer only upon being intimated by the bus operator.

Ticket Cancellation & Refund:

.        Tickets will be cancelled as per the cancellation policy mentioned with the ticket. The transaction charges will not be refunded in the event of ticket cancellation. Partial cancellation of Bus ticket is not available. Reschedule of Bus ticket is not available.

.        Refund policy mentioned on the ticket is indicative. The actual cancellation charges are determined by bus operators and bus providers at the actual time of cancellation. PayPappa has no role in governing the cancellation charges.

.        Cancellation charges are calculated on the actual fare of the ticket. If any discount coupons are used while purchasing the ticket, the discounted value would be used to calculate the refund amount when a ticket is cancelled. Refunds on ticket cancelled will be directly transferred to the respective account from which payment was made at the time of booking.

.        In case a booking confirmation e-mail and sms gets delayed or fails because of technical reasons or as a result of incorrect e-mail ID / phone number provided by the user etc, a ticket will be considered ‘booked’ as long as the ticket shows up on the confirmation page of www.PayPappa.com.

.        Amenities for this bus as shown on PayPappa have been configured and provided by the bus provider (bus operator). These amenities will be provided unless there are some exceptions on certain days. Please note that PayPappa provides this information in good faith to help passengers to make an informed decision. Provision of video, air conditioning and any such other services mentioned by PayPappa’s travel partners in the buses is their own responsibility. Any refunds / claims due to non-functioning or un-availability of these services needs to be settled directly with the bus service provider.

Domestic Flight Booking Terms

.        The total price displayed on the Site includes all applicable government taxes.

.        You are required to pay the entire amount prior to the confirmation of your booking.

.        There will be no refund for 'no-shows' or any partially unused flights.

.        Refund against partially utilized ticket is as per airlines terms and conditions and could take up to 90 days.

.        To avail of infant fares, an infant must be under 24 months throughout the entire itinerary you are booking. This includes both onward and return journeys. If the infant is 24 months or above on the return journey, you'll need to make a separate booking using a child fare.

.        Infants must be accompanied by an adult at least 18 years of age.

.        All Tickets/Bookings issued to the customer shall additionally be governed under the terms and conditions as laid out by the respective Airlines / supplier.

.        We recommend user to refer airlines terms and conditions before booking the ticket.

.        By accepting our booking terms, user is also agreeing to terms & conditions of the respective airline.

.        PayPappa charges a non-refundable convenience charge of Rs.200/- for oneway flights and Rs.350/- for roundtrip flights additionally on per passenger basis.

.        Friends and Family Special Fares are applicable only on both Domestic and International sectors.

.        Special Fares are applicable for minimum two and maximum nine passengers in one booking.

.        Seats are subject to availability.

.        Special Fares are not applicable on group bookings.

.        Normal baggage allowance applicable for these fares. Airlines Charges Rs. 1500 change/Cancel fee. Air Pegasus charges Rs. 1000 towards change/cancellation. In case of Indigo/GoAir Airlines if cancelled/changes done within 0-2 hrs before scheduled departure then entire airfare would be forfeited as airline charges. Only Government taxes will be refunded. If cancelled/changes done within 2-48 hrs before scheduled departure then Rs. 2250 would be charged as airline charges. If cancelled/changes done within 48 hrs-7 days before scheduled departure then Rs. 2000 would be charged as airline charges. If cancelled/changes done within 7 – 30 days before scheduled departure then Rs. 1500 would be charged as airline charges. If cancelled/changes done within 30 days or more before scheduled departure then Rs. 1250 would be charged as airline charges. Minimum 2 passengers will be required in the PNR after cancellation in case booked under family fare.

.        All statutory taxes, surcharges and fees are to be paid by the passenger, as applicable on the date of travel.

.        Flight schedules and timings are subject to regulatory approvals and change(s).

Check-in:

.        As per the airline rules, the standard check-in time begins 2 hours before departure for domestic flights.

.        For International flights, the check-in time is 3 hours before departure.

.        The passenger needs to check-in at least 2 hrs prior departure for Air India and Air India Express domestic flights else will be considered as a no show.

.        Infants must have valid proof-of-age documents showing that the infant is less than two years old.

Amendments:

.        Every booking made on PayPappa is subject to amendment charges levied by the airline, which may vary by flight and booking class.

.        In case of Online Reschedule, the existing booking id will be auto cancelled with applicable airlines cancellation charges and a fresh booking id will be generated as per current pricing.

.        If you amend your booking, you will be charged the difference in fare, if any, applicable when the amendment is made. However if the new fare is lower than the Original fare, difference in the amount will not be refunded,but the rebooking charges as applicable will be collected.

.        We'll collect these charges from you when we make the changes to your travel plans. We'll also collect the difference in fare, if any, applicable when the amendment is made.

.        Depending on the airline's policy, some booked fares may not be amended.

Cancellation Policy:

.        Every booking made on PayPappa is subject to cancellation charges levied by the airline, which may vary by flight and booking class.

.        Some booked fares may be non-refundable per the specific airline's policy.

.        Online cancellations: Cancellations can be made online by Customer Support page.

.        We accept cancellation requests through email.

.        PayPappa cancellation charges: In addition to the airline cancellation charges, PayPappa will charge Rs 250 per passenger per sector for each cancellation.

.        Only cancellation requests made online email (For emails travel date must be more than 48 Hrs) through our customer support shall be entertained. PayPappa shall not be liable to entertain any cancellation requests made through any other medium.

.        For e-tickets, if your cancellation request is made less than 4 hours before departure, you'll need to contact the airline directly to get your reservation cancelled. We will not be able to provide any assistance for these cancellations.

.        For e-tickets, if your cancellation request is made less than 24 hours before departure, you'll need to contact our customer care executive through email. The request through any other medium will not be entertained.

.        If you have done a 'Web/Tele Check-in' with the airline, get in touch with the airline for cancellation. PayPappa will not be able to process the refund for the same and will not take any responsibility for the same.

Refund:

.        It is mandatory to contact PayPappa for all refunds, as the airline will not be able to refund your tickets booked at paypappa.com.

.        All cancellations made directly with the Airline need to be intimated to PayPappa or our partner by Email or Phone in order to initiate the refunds process.

.        Processing times for cancellation and refund requests vary.

.        Convenience charge of INR 200/- for one-way flight and INR 350/- for roundtrip flights, paid at the time of booking is a non-refundable fee and same shall be applicable on all cancellations including any partial cancellation requests.

.        The refund will be credited back to the same account from where the payment was made.

.        On the event of cancellation and refund of partially utilized tickets upfront discount and promo code discount availed at the time of booking would be deducted from the refund amount.

.        In case, where the user has cancelled his/her booking directly with the airlines, he/she will need to inform Company with valid documentation to initiate the refund process. It is advisable to contact Company within 48 hours of the cancellation request.

.        The meal amount is non-refundable. (Refundable only if the flight is cancelled by the airlines).

.        Company will be able to initiate customer's refund only after receipt and/or confirmation of refund from the airline.

Meal Selection Policy:

.        The meal amount is non-refundable. (Refundable only if the flight is cancelled by the airlines).

.        The meal option is as per the flight's menu and availability.

.        The meal would be served only once in case of connecting flights.

.        The meal option is allowed only for adults and children (above 2 years of age).

Travel Insurance:

.        If Travel Insurance has been accidentally added as part of a PayPappa booking, and customer wishes to cancel the insurance, PayPappa will cancel the insurance free of charge if request is made atleast 48 hours prior to date of journey..

.        Insurance is only valid for trips emerging from Indian Airport and destination is within India or outside India. Any trip emerging from outside India, insurance is not applicable.

.        Insurance is only applicable for Indian Nationals between age 0 to 70.

.        Domestic insurance cancellation charge of Rs. 60 is applicable.

Note:

.        PayPappa.com is a facilitation platform providing easy and convenient access to reservations. Due to the volatile nature of the aviation industry, airlines delay and default in refund of tickets. PayPappa.com shall be in a position to process customer refunds against flight tickets only if the same have been refunded by the respective Airline. In the event an airlines discontinues its operations, paypappa.com will not be accountable for any customer refunds wherein the same have not been refunded by the Airlines.

International Flight Booking Terms

.        The total price displayed includes all applicable government taxes. Excludes all applicable airport taxes or other charges payable at the airport.

.        You are required to pay the entire amount prior to the confirmation of your booking.

.        Name entered in traveler's details should be exactly as per the passport. Name changes after booking are not allowed.

.        There will be no refund for 'no-shows' or any partially unused flights.

.        Meals, frequent flyer miles and special service are on request basis only and are subject to airlines terms and conditions and confirmation.

.        For any information regarding your Frequent Flyer miles or promotion/ tie-ups, please contact the airline directly.

.        Kindly ensure that you have the relevant visa, transit visa (if applicable), immigration clearance and travel with a passport, with a validity of at least 6 months as on date of travel. .        To avail infant fares, an infant must be under 24 months throughout the entire itinerary you are booking. This includes onward and return journeys. If the infant is 24 months or above on the return journey, you will be required to make a separate booking using a child fare.

.        Infants must be accompanied by an adult at least 18 years of age.

.        PayPappa is not responsible for any schedule change by the airline after issuance of the ticket, but will inform you of the same if informed by the airlines. It is advisable to reconfirm your flight timings 24 hours prior to your flight departure.

.        PayPappa will charge transaction fees for availing the PayPappa Services. PayPappa reserves the right to alter any and all kinds of transaction fees from time to time, without notice. You shall be liable to pay all applicable charges, fees, duties and taxes for availing the PayPappa Services.

.        Minimum 2 passengers will be required in the PNR after cancellation in case booked under family fare.

.        PayPappa charges a non-refundable convenience charge of Rs.250/- for oneway flights and Rs.399/- for roundtrip flights additionally on per passenger basis.

.        PayPappa reserves the right to cancel any booking made by any travel agent using promotional offers for business purpose without any prior notice. The promotional offers are strickly meant for bookings booked for personal travel only.

Check-in:

.        The passenger is required to check-in at least 3 hours prior departure for International flights, else will be considered as a no show.

.        As per the airline rules, the standard check-in time begins 3 hours before departure.

.        Infants must have valid proof-of-age documents showing that the infant is under two years old.

.        You need to carry appropriates travels permissions (Valid Passport, Visa, Immigration clearance etc.) done before departure. PayPappa is not responsible for any issues related to documents (invalid or inappropriate travel documents).

Amendments:

.        PayPappa can assist you with amendments to most bookings. In some cases, though, you'll need to contact the airline directly.

.        Every booking made on PayPappa is subject to amendment charges charged by the airline, which may vary by flight and booking class.

.        If you amend your booking, you will be charged the difference in fare, if any, applicable when the amendment is made. However if the new fare is lower than the original fare, difference in the amount will not be refunded. The rebooking charges as applicable will be collected.

.        In addition to the airline's amendment charges, PayPappa charges an amendment service fee of Rs 500 per passenger per sector.

.        We'll collect these charges from you when we make the changes to your travel plans. We'll also collect the difference in fare, if any, applicable when the amendment is made.

.        Depending on the airline's policy, some booked fares may not be amended.

.        Air Arabia bookings cannot be rescheduled or changed with us. For rescheduling or changing the ticket, please contact airline directly and it is subject to airline's terms and conditions.

.        Every booking made on PayPappa is subject to cancellation charges levied by the airline, which may vary by flight and booking class.

.        Some booked fares may be non-refundable per the specific airline's policy. There will no refund in such cases.

.        On top of the airline's cancellation charges, PayPappa charges a service fee of Rs 500 per passenger per sector.

.        All cancellations should be done at least 48 hrs (2 days) prior to departure date. Certain airlines do not allow any changes or cancellation within 48 hrs and treat the booking as a "No Show".

.        For e-tickets, if your cancellation request is made less than 48 hours prior to departure, you'll need to contact our customer support team: [email protected]

.        If you have done a 'Web/Tele Check-in' with the airline, get in touch with the airline for cancellation. PayPappa will not be able to process the refund for the same and will not take any responsibility for the same.

Partial Payment Terms and Condition:

.        Incase of partial payment mode, the remaining amount should reflect in our account as on due date suggested to you while booking the tickets.

.        Partial Payment Bookings are confirmed and ticket details would be mailed to you once your payment is received and realized in full. In the event of non-receipt of the balance payment within stipulated time, the reservation will be auto-cancelled and the guarantee amount paid will be forfeited.

.        Until the payment is realized in full, should there be an increase in airfare or taxes, the same will be intimated and charged to you.

.        Until the payment is realized in full, the booking is subject to cancellation by the airline or PayPappa.com without prior notice.

.        If the payment is not approved on given credit card number(s), you will be notified as soon as possible. In such a scenario you need to speak to the credit card company, or provide alternate credit card number, or change mode of payment as applicable.

On Hold Terms and Condition:

.        PayPappa will charge Rs. 500 for holding a ticket at a specified price for a specified interval of time. However, the ticket will be issued only if the balance payment is realized by PayPappa within the stipulated time subject to following terms and conditions.

.        Until the payment is realized in full, should there be an increase in airfare or taxes, the same will be intimated and charged to you.

.        Until the payment is realized in full, the booking is subject to cancellation by the airline or PayPappa without prior notice.

.        If the payment is not approved on given credit card number(s), you will be notified as soon as possible. In such a scenario you need to speak to the credit card company, or provide alternate credit card number, or change mode of payment as applicable.

.        Under all conditions, we should realize your payment within the stipulated time in order for the issuance of the ticket at same fare.

.        In case of delay of payment realization because of any third party and should there be an increase in airfare or taxes, the same will be intimated and charged to you.

.        No Promo Code usage will be allowed in booking tickets through Hold Functionality. In case of any use of Promo Code with hold ticket functionality, the ticket will be cancelled and the amount forfeited.

.        In case of unavailability of the ticket by our partner airlines, we will refund your paid amount without any deductions.

.        This service is subject to the airline’s terms and conditions.

.        All the bookings made through this service is subject to PayPappa terms and conditions and the airline terms and conditions.

.        The airline terms and conditions can change without any notice. For the latest terms and conditions, please check with directly with the airline.

.        In case of cancellation and rescheduling, the initial amount paid for holding the ticket is non-refundable.

Insurance:

.        Insurance is a third party product and is subject to terms and conditions of the third party service provider. PayPappa in no way be held liable to any deficiencies of service and/or in any dispute between the customer and the third party service provider.

.        For any service related issues and/or any disputes regarding insurance needs to be settled directly with the third party service provider.

.        In case of rescheduling of the ticket, PayPappa cancels the insurance and refund the insurance amount back to customer through the same mode of payment as used while booking the tickets on PayPappa.

.        In case of cancellation of the ticket, PayPappa cancels the insurance and refund the insurance amount back to customer through the same mode of payment as used while booking the tickets on PayPappa.

.        In case of rescheduling of the ticket, PayPappa, in any case whatsoever, will never issue the new updated insurance policy to the customer. The policy gets cancelled automatically and the refund is initiated by PayPappa back to the customer in such cases.

.        Travel Insurance: If Travel Insurance has been accidentally added as part of a PayPappa booking, and customer wishes to cancel the insurance, PayPappa will cancel the insurance free of charge if request is made atleast 48 hours prior to date of journey.

.        Insurance is only valid for trips emerging from Indian Airport and destination is within India or outside India. Any trip emerging from outside India, insurance is not applicable.

.        Insurance is only applicable for Indian Nationals between age 0 to 70.

.        Domestic insurance cancellation charge of Rs. 45 is applicable.

In addition to above terms and conditions, please check the terms and conditions of the respective airline booked by you. The terms and conditions of the respective airline booked by you applies to you.

Note:

.        PayPappa.com is a facilitation platform providing easy and convenient access to reservations. Due to the volatile nature of the aviation industry, airlines delay and default in refund of tickets. PayPappa.com shall be in a position to process customer refunds against flight tickets only if the same have been refunded by the respective Airline. In the event an airlines discontinues its operations, PayPappa.com will not be accountable for any customer refunds wherein the same have not been refunded by the Airlines. PayPappa doesn't allow Ex-India booking on its platform and reserves the right to cancellation without prior notice in case of any such booking made on its platform in any way. In the event of cancellation by PayPappa, PayPappa will refund the booking amount to the consumer after deducting the airline charges and PayPappa fees applicable.

Visa Obligations of the User

.        The travel bookings done by the Company are subject to the applicable requirements of Visa which are to be obtained by the individual traveler. The Company is not responsible for any issues, including inability to travel, arising out of such Visa requirements and is also not liable to refund for the untraveled bookings due to any such reason.

Hotel Booking Terms

.        PayPappa act only as an intermediary agent with only the role of a mediator. Even if you make a booking through us, the contract will be between the supplier and you and the general travel and contractual terms and conditions of the supplier shall apply. We are not a party to the contractual relationship.

.        Hotels may not allow local residents to check-in as guests . This is strictly subject to the Hotel Policies and PayPappa will not be responsible for such check-in denials.

.        Hotels reserves the right of admission. Unmarried/unrelated couples may not be allowed to check-in. Similarly accommodation can be denied to guests posing as a Couple if suitable proof of identification is not presented at check-in. PayPappa will not be responsible for any check-in denied by the hotel due to the aforesaid reason. No refund would be applicable in case the hotel denies check-in under such circumstances.

.        Hotel may deny check in to guests providing Id Proof of the same city as the hotel itself.

.        The hotel pictures/information on the website, including amenities and facilities are provided by the hotel. This information is for reference only. For any discrepancy that exists between the website pictures and actual settings, PayPappa is not liable and responsible.

.        It is mandatory for you to send the auto generated form filling your correct credit card details immediately to the hotel in order for the booking to be confirmed by the hotel/accommodation.

.        The booking is not confirmed until the filled auto generated form is sent to the hotel.

.        The credit card details should be sent only via the auto generated form and in no other format.

.        Prior to the filling of the auto generated form being sent to the hotel by you, your booking is only provisional and hotel has no obligation to reserve a room for you.

.        The hotel shall confirm your booking post authorising and verifying the credit card details.

.        The hotel may deny your booking if it is not able to authenticate and verify the credit card details as per its terms and conditions.

.        The Company does not store your credit card in details database as they are sent by you directly to the hotel and stored by the hotel.

.        The hotel might block your credit card for the amount of the booking as per the hotel's terms and conditions and the Company shall not be responsible for the same.

.        The primary guest must be at least 18 years old to be able to check into the hotel.

.        Check-in time and check-out time is as per hotel policy & terms. Early check-in or late check-out request is subject to availability and the hotel might charge you extra for it. Please note that the check-in time is subject to change as per hotel policy & seasonality.

.        Your stay does not include additional personal expenses like telephone charges, meals that aren't part of your meal plan, any hotel services you use (like laundry and room service) or tips. The hotel will charge you directly for these when you're checking out.

.        It is mandatory for guests to present valid photo identification at the time of check-in. According to government regulations, a valid Photo ID has to be carried by every person above the age of 18 staying at the hotel. The identification proofs accepted are Drivers License, Voters Card, and Passport. Without valid ID the guest will not be allowed to check in. Note- PAN Cards will not be accepted as a valid ID card.

.        The hotel reserves the right of admission. Accommodation can be denied to guests posing as a 'couple' if suitable proof of identification is not presented at check-in. Company will not be responsible for any check-in denied by the hotel due to the aforesaid reason.

.        Hotels may charge a mandatory meal surcharge on festive periods e.g. Christmas/ New Year's Eve or other festivals as decided by the hotel. All additional charges (including mandatory meal surcharges) need to be cleared directly at the hotel.

.        Government has levied service tax on hotel room charges effective on stays from 1st May 2011. This tax may be required to be settled directly at the hotel.

.        Time Zone applicable for content displayed on the website shall be Indian Standard Time for all purposes unless explicitly mentioned otherwise.

Additional Terms and conditions applicable for all hotel offers:

.        All taxes, duties, levies or other statutory dues and charges payable in connection with the benefits accruing under the Cashback shall be borne solely by the Customer and PayPappa shall not be liable in any manner whatsoever for any such taxes, duties, levies or other statutory dues and charges.

.        Customers are requested to be accustomed, satisfy and agree to with these terms and conditions of the Cashback before participating in or making any purchase in relation to this Cashback. Participation in the Cashback is discretion of Customer.

.        Customers are not being charged extra for participating in the Cashback.

.        Liability of PayPappa shall be limited to the extent of the cash back to which Customer is entitled as per terms and conditions.

.        Decision of PayPappa in respect of Cashback, benefits or any matters related thereto shall be final and binding and no correspondence will be entertained in this behalf.

.        All disputes are subject to exclusive jurisdiction of the competent courts in Kerala, India only.

.        By participating in this Scheme, Customers agree to be bound by these terms and conditions and waive any right to claim ambiguity in these terms & conditions. PayPappa does not provide any warranties with regard to the quality or fitness for any purpose of the hotels available under the Cashback. Customers agree to release, discharge, indemnify and hold harmless PayPappa, and its directors, officers, employees and agents, from and against any claims, damages or liability due to any injuries or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, use, or loss of any Cashback related benefit/hotel booking, or participation in any Cashback-related activity or participation herein.

.        All other standard terms and conditions applicable are listed on www.PayPappa.com.

.        PayPappa reserves the right to:

.        i) change/ amend / add /delete/ modify terms and conditions of this Cashback without assigning any reasons whatsoever. Customers acknowledge that they will not be personally advised of any such change/ amendment / addition /deletion/ modification. Customers are advised to check for any such change/ amendment / addition /deletion/ modification regularly. Customers hereby unconditionally agree to all such changes/ amendments/ additions/ deletions/ modifications.

.        ii) Discontinue or extend the Cashback period without assigning any reasons whatsoever.

Specific Pay at hotel Terms:

Cancellation Policy:

.        The Cancellation Policies of the Hotels are dynamic and may change from time to time. The Cancellation policy of the Hotel may change in the interim period of booking and date of stay of the Guest. The Cancellation Policy prevailing at the time of check in/cancellation of the booking by the Customer will be the applicable policy.

.        Hotels being booked may have their own cancellation policy and may charge user accordingly.

.        In the event of Cancellation the money shall be debited from your credit card directly by the Hotel as per Cancellation Policy of the Hotel.

.        On cancellation of bookings done using promotional codes, the hotel cancellation charges are calculated on total price before discount. For such bookings, an additional PayPappa cancellation charge of 10% or Rs.500, whichever is minimum will be deducted from the refund amount after applying the hotel cancellation policy. For goStay bookings, PayPappa cancellation charge of 50% will be deducted.

.        Cancellations can be done online or send an email to [email protected] with details.

.        Only those cancellation requests which are made either online or on the phone to our customer support team shall be entertained. The Company shall not be liable to entertain any cancellation requests made directly to the hotel without intimating the Company and also through any other medium including, but not limited to, SMS or e-mail.

.        If you don't show up at the hotel, you'll still be charged the entire amount and hotel will debit the amount from your card directly.

Refunds and Modification:

.        The company do not accept amendment request to the hotel reservation if the check in is within 48 Hours.

.        The Company doesn't support changes and modifications to online bookings once they're made.

.        All the refunds shall be done by the Hotel directly to you and the Company is not responsible to ensuring any refunds whatsoever.

.        Your bank may debit its own separate charges from refunds made to your credit card or bank account.

General Terms Of PayPappa Wallet:

.        PayPappa Wallet is used for the pre-paid payment option issued by PayPappa.

.        Customer or you mean a person who has registered with PayPappa for availing the PayPappa Wallet and who has accepted these Terms and Conditions and, owns/operates/has access to an internet compatible device that supports the PayPappa Wallet.

.        Charge(s) or Service Charge shall mean the charges which PayPappa may levy upon you in consideration for subscribing to the PayPappa Wallet. Merchant Establishment shall mean and include physical Merchants, remote Merchants and any other outlet that has been authorized by PayPappa to accept payment using PayPappa Wallet.

.        You may recharge your PayPappa Wallet through any of the online banking methods, the list of recharge outlets and methods of recharging PayPappa Wallet are subject to change at the discretion of PayPappa without prior intimation to the Customer.

.        You may note that withdrawing money from PayPappa Wallet is not allowed. Any outstanding credit PayPappa Wallet must be utilized only to make payments for products/ services.

.        PayPappa Wallet are available only to resident Indians who have attained the age of 18 years and are competent to contract.

.        PayPappa Wallet are not transferable.

.        The value stored on your PayPappa Wallet shall NOT be refunded under ANY circumstances and may only be utilized to make payments for products/services transactions No interest will be payable by PayPappa on the available balance reflected on the PayPappa Wallet.

.        You are permitted to maintain and operate only one PayPappa Wallet. Any suspected non-conformity with this requirement shall be just cause for the suspension/ discontinuation of any/all Wallets associated with you by PayPappa.

.        If we receive any complaint related wallets merchant has to blocked wallet & initiate refund to card holder account via same way.

Communication Policy

    1. By registering to use the Site, below, you consent to conduct transactions and receive communications, notices and information from us electronically, whether sent by e-mail or other electronic means. Electronic communications shall be deemed to have been received by you when We send the electronic communication to the email address/mobile number that as per our records, or when We post the electronic communication on the PayPappa Site. The requirements for such electronic transactions and communications following: you must have access to the Internet, mobile web, applications and a valid e-mail address. You can withdraw your consent at any time by contacting us, but We reserve the right to terminate your account upon such withdrawal. Withdrawal of your consent will not affect the legal validity and enforceability of any notice, statement or disclosure previously received electronically. You agree to notify us promptly if your email address or other contact information changes by updating your account information or contacting us.

Use of Site

You understand that except for information, products or services clearly indicated as being supplied by the PayPappa, we do not operate, control, or endorse any information, products or services on the Internet in anyway. You also understand that PayPappa cannot and does not guarantee or warrant that files available for downloading through the Site will be free of viruses, worms or other code that may be damaging. You are responsible for implementing procedures to satisfy your particular requirements and for accuracy of data input and output.

Prohibited Conduct

By using the Services you agree not to:

  • use the Services for any purposes other than to purchase Recharge of Telcos and/or to access the Services in accordance with these Terms and Conditions and as such services are offered by PayPappa
  • impersonate any person or entity, falsely claim or otherwise misrepresent an affiliation with any person or entity, or access the accounts of others without permission, forge another persons’ digital signature, misrepresent the source, identity, or content of information transmitted via the Services, perform any other similar fraudulent activity or otherwise purchase Recharge with what we reasonably believe to be potentially fraudulent funds
  • infringe our or any third party’s intellectual property rights, rights of publicity or privacy
  • use the Services if You are under the age of eighteen (18) without a parental sponsor or in any event use the Services if You are under the age of thirteen (13) years old even with a parental sponsor and in accordance with applicable law
  • post or transmit any message which is libelous, defamatory or which discloses private or personal matters concerning any person
  • post or transmit any message, data, image or program which is pornographic in nature
  • refuse to cooperate in an investigation or provide confirmation of Your identity or any other information You provide to PayPappa
  • remove, circumvent, disable, damage or otherwise interfere with security-related features of the Services and the Site or features that enforce limitations on the use of the Services
  • reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Services or any part thereof, except and only to the extent that such prohibition is expressly prohibited by applicable law notwithstanding this limitation
  • use the Services in any manner that could damage, disable, overburden, or impair it, including, without limitation, using the Services in an automated manner
  • modify, adapt, translate or create derivative works based upon the Services and the Site or any part thereof, except and only to the extent that such prohibition is expressly prohibited by applicable law notwithstanding this limitation
  • intentionally interfere with or damage operation of the Services or any other user’s enjoyment of it, by any means, including uploading or otherwise disseminating viruses, adware, spyware, worms, or other malicious code or file with contaminating or destructive features
  • use any robot, spider, other automatic device, or manual process to monitor or copy the Site without prior written permission
  • interfere or disrupt this Site or networks connected to this Site
  • take any action that imposes an unreasonably or disproportionately large load on our infrastructure/ network
  • use any device, software or routine to bypass the Site’s robot exclusion headers, or interfere or attempt to interfere, with the Services
  • forge headers or manipulate identifiers or other data in order to disguise the origin of any content transmitted through our Site or to manipulate your presence on our Site
  • sell the Services, information, or software associated with or derived from it
  • use the facilities and capabilities of the Site to conduct any activity or solicit the performance of any illegal activity or other activity which infringes the rights of others
  • breach this Agreement or any other PayPappa agreement or policy
  • provide false, inaccurate or misleading information
  • use the Site to collect or obtain personal information, including without limitation, financial information, about other users of the Site
  • purchase Recharge with what PayPappa reasonably believes to be potentially fraudulent funds
  • use the Services in a manner that results in or may result in complaints, disputes, reversals, chargebacks, fees, fines, penalties and other liability to PayPappa , a third party or You
  • use the Services in a manner that PayPappa or any payment card network reasonably believe to be an abuse of the payment card system or a violation of payment card network rules
  • take any action that may cause PayPappa to lose any of the Services from its service providers, Telcos, payment processors or other suppliers
  • send automated request of any kind to the Site’s system without express permission in advance from PayPappa.

Ownership; Proprietary Rights

The Services and the Site are owned and operated by PayPappa and/or third party licensors. The visual interfaces, graphics, design, compilation, information, computer code (including source code and object code), products, software, services, and all other elements of the Services and the Site provided by PayPappa (the “Materials”) are protected by Indian copyright, trade dress, patent, and trademark laws, international conventions, and all other relevant intellectual property and proprietary rights, and applicable laws. As between you and PayPappa, all Materials, trademarks, service marks, and trade names contained on the Site are the property of PayPappa and/or third party licensors or suppliers. You agree not to remove, obscure, or alter PayPappa or any third party’s copyright, patent, trademark, or other proprietary rights notices affixed to or contained within or accessed in conjunction with or through the Services. Except as expressly authorized by PayPappa, you agree not to sell, license, distribute, copy, modify, publicly perform or display, transmit, publish, edit, adapt, create derivative works from, or otherwise make unauthorized use of the Materials. PayPappa reserves all rights not expressly granted in this Agreement. If you have comments regarding the Services and the Site or ideas on how to improve it, please contact customer service. Please note that by doing so, you hereby irrevocably assign to PayPappa, and shall assign to PayPappa, all right, title and interest in and to all ideas and suggestions and any and all worldwide intellectual property rights associated therewith. You agree to perform such acts and execute such documents as may be reasonably necessary to perfect the foregoing rights.

Eligibility and Registration to Use the Services

    1. You must be 18 years old to use PayPappa. You must be an authorized representative with the authority to bind that company or entity to these Terms. You agree to provide accurate, current and complete information about yourself or your company as prompted by our registration form (including your email address) and maintain and update your information (including your email address) to keep it accurate, current and complete. We reserve the right to terminate any account or your use of the Site or the Platform/Network if any information provided by you is false, fictitious, inaccurate, not current or incomplete, with or without notice to you.
    2. You will be issued a user id and password to access your account. You must keep password confidential and not share it with any other person. You are responsible for all activity on your account, whether or not you authorized it. However, if you become aware of any unauthorized use of your account or your user id and password, please contact us immediately.

·          Intellectual Property Rights

    1. We, or our licensors, own all right, title and interest, including, but not limited to all copyright, trademark, patent, trade secret or other proprietary rights (“IP Rights”), in and to the Site, the Platform, the Usage Data. You shall not reproduce, distribute, transmit, modify, create derivative works, display, perform or otherwise use the Site, the Platform or any of the IP Rights, or attempt to reverse engineer, decompile, disassemble, or derive the source code for the Platform or use the Platform or Site to create a competing product. PayPappa is owned by Dami Technologies. Unauthorized use is strictly prohibited. All rights are expressly reserved to PayPappa.

Indemnification

The USER agrees to indemnify, defend and hold harmless the Company and/or its affiliates, their websites and their respective lawful successors and assigns from and against any and all losses, liabilities, claims, damages, costs and expenses (including reasonable legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by the Company and/or its affiliates, partner websites and their respective lawful successors and assigns that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by the User pursuant to this agreement. The user shall be solely and exclusively liable for any breach of any country specific rules and regulations or general code of conduct and Company cannot be held responsible for the same..

·          Disclaimer

    1. WE MAKE NO WARRANTY, EXPRESS OR IMPLIED, WITH RESPECT TO THE SITE, THE PLATFORM/NETWORK AND SERVICES OFFERED. WE EXPRESSLY DISCLAIM THE IMPLIED WARRANTIES OF NONINFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR ANY PARTICULAR PURPOSE. We provide the Site, the Platform/Network and any other technology and services on the Site on an “as is”, “where is”, “with all faults” basis. We do not warrant that the Site or the Platform any products and services shown or described on the Site, or other technology and services will be uninterrupted, error-free, available or operational at any particular time, or that any known defects will be corrected.

·          Limitation of Liability

The site is not to be held liable for special, consequential, incidental, indirect or punitive loss, damage or expenses, data, loss of facilities, or equipment or the cost of recreating lost data regardless of whether arising out of a breach of contract, warranty, tort, strict liability or otherwise. The User shall agree that the Site shall not be liable for any damage, monetary loss resulting from transactions resulting to the damage of the User's reputation resulting from bogus entries.

Information Technology Act & Indian Laws

The "User" agrees and undertakes to abide by the provisions of Information Technology Act and/or any other laws/rules/regulations of India. The User impliedly and expressly undertakes to submit to the jurisdiction of enforcing/statutory authorities for any violation of the IT act and other laws.

Choice of Law and Dispute Resolution

1.        These Terms shall be governed by, and construed in accordance with, the laws of India, without reference to principles of conflicts of law. The parties agree that the courts of Thiruvalla, Kerala, India, shall have exclusive jurisdiction over any dispute arising from or relating to these Terms, the Platform/Network or the Site. You expressly consent to the personal jurisdiction of said courts and waive any objection to such personal jurisdiction based on forums non convenience or any other basis.

Modification of this Agreement

PayPappa reserves the right to change, modify, add, or remove portions of this Agreement at any time. If you do not agree with any such modification, your sole and exclusive remedy is to terminate your use of the Services. User is required to check terms and conditions at every visit. No notification communication will be done subject to change in terms and conditions.
